About the registration requirement

From when do I have to record working time?

From 1 January 2027. Social secretariats (sociale secretariaten, the payroll service providers many employers use) such as SD Worx and Acerta speak of a transition period until 31/03/2027.

Better not to wait for that. If you start earlier, clocking in will already be a habit for everyone by then.

Does this apply to my small business too?

Yes. The duty applies to all employers, private and public, however small. Even if you have only one employee.

An exception is likely for some groups: staff in a managerial role or a position of trust, sales representatives, home workers and teleworkers, travelling staff and family businesses where only blood relatives work. That list is not fixed yet.

Do you work in construction, cleaning or hospitality? Checkin@work, check-in at work and the GKS (the registered cash register system) are separate obligations. They don't replace this registration.

As the owner, do I have to record my own hours too?

The duty is about employees: people who work for you under an employment contract. If you are a self-employed owner (zaakvoerder), you are not covered, going by what is known today.

In kloko the owner does not count as an employee. So you don't pay for yourself.

What exactly do I have to record?

The daily working time of every employee, in a system that is objective, reliable and accessible.

  • Objective: the times are captured at the moment itself, not filled in afterwards.
  • Reliable: nothing changes silently. Every correction shows who, when and why.
  • Accessible: your employee sees their own hours and corrections. The Social Inspectorate (Sociale Inspectie) gets a readable overview.

kloko records the start, the breaks and the end for each day.

Is Excel or paper still enough?

No. An Excel sheet or a paper list does not count as an objective system.

A classic time clock is not needed either. You choose: an app, software, a badge or a clock.

What do I risk without registration?

The penalties are not fixed yet. The Social Criminal Code (Sociaal Strafwetboek) still applies. For now, an amount of €250 to €2,500 per employee is being mentioned.

At least as important: without registration, in a dispute about overtime the whole burden of proof is on you.

How long do I have to keep the data?

Usually 5 years is mentioned, but that is not final yet. kloko keeps your records for at least 5 years and will adjust that if the law asks for something different.

What if someone forgets to clock in?

Then your employee requests a correction in the app: what went wrong, the right time and a reason. You approve or reject it.

The original time always stays visible, including in the inspection PDF. As the owner you cannot quietly change hours yourself.

What does my employer see?

Only your start and end times, your breaks and your totals. No location, no photos, no fingerprint, and nothing of what else you do on your phone.

In the app you see the same hours as your employer. That gives you proof too, for example of your overtime.

What do I do during an inspection?

Choose the employee and the period, and download the inspection PDF. It lists the start, the end, the breaks and the total for each day. Every correction is included, with the old time, the new time, the reason and who approved it.

Does kloko work with my social secretariat?

You download the hours per employee and per period as an Excel or CSV file and pass it to your social secretariat. There is no direct link yet.

Nothing changes for your payroll: kloko records the working time, your social secretariat calculates the pay.

Is kloko in line with the GDPR?

kloko works without biometrics and without GPS. Fingerprints and facial recognition are sensitive data under Article 9 of the GDPR and carry a high risk for you as an employer.

We only record what is needed: when someone starts, takes a break and stops.
